Ensuring the safety of tenants is a top priority for landlords, and one critical aspect of this is providing and maintaining smoke alarms in rental properties. In Alabama, landlords are legally required to install and maintain smoke alarms in rental properties, and it is crucial for tenants to understand their responsibilities in maintaining these devices.

Smoke alarms are a vital safety feature that can save lives in the event of a fire. In fact, according to the National Fire Protection Association, three out of five home fire deaths occur in homes without working smoke alarms. To ensure the safety of tenants, landlords must ensure that smoke alarms are installed and in working order before tenants move in and maintain them throughout the lease.

The State of Alabama has adopted the International Fire Code that requires residential homes to have working smoke alarms. Furthermore, Alabama Code 35-9a-204 states, “A landlord shall comply with the requirements of applicable building and housing codes materially affecting health and safety of a tenant.”

Tenants are, however, responsible for maintaining smoke alarms by regularly testing them and notifying their landlords of device issues, such as if they are not working or if the batteries need replacing. By working together, landlords and tenants can help ensure that rental properties are safe and secure for everyone.

In addition to providing and maintaining smoke alarms, landlords should also educate their tenants on fire safety. This includes creating a fire escape plan, practicing fire drills, and ensuring that all exits are clear and easily accessible. By having a plan in place, tenants can be better prepared in the event of a fire.

If a smoke alarm goes off, it is critical to evacuate the building immediately and call 911 to report the fire. In the event of a fire, every second counts, and having working smoke alarms can make all the difference. Landlords should ensure that smoke alarms are installed on every level of a home, outside of sleeping areas, and inside each bedroom. The smoke alarms should be tested monthly and replaced every ten years.

By following these guidelines and working together, landlords and tenants can help ensure that rental properties in Alabama are safe and secure for all residents. By prioritizing the safety of tenants, landlords can create a positive and secure living environment for all.
